Not to use our Services to distribute malware, spam, or any other harmful or malicious content.
Not to reverse engineer, decompile, disassemble, or attempt to derive the source code of our software, except as permitted by law.
Intellectual Property
All intellectual property rights, including copyrights, trademarks, and trade secrets, in our Services are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use our Services for your personal or business use, subject to these Terms.
You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise use our Services, except as expressly permitted by these Terms or with our prior written consent.
Fees and Payments
You agree to pay all fees associated with the Services you purchase, as set forth in the applicable order form, quote, or invoice. All fees are in Swiss Francs (CHF) and are exclusive of any applicable taxes, which will be added to your invoice.
Payment terms will be specified in the relevant order form, quote, or invoice. Late payments may be subject to interest charges at the rate of 1.5% per month or the highest rate allowed by law, whichever is lower.
Warranty and Disclaimer
We warrant that our Services will be provided in a professional and workmanlike manner, consistent with industry standards. In the event of a breach of this warranty, your sole remedy will be, at our option, to re-perform the affected Services or refund the fees paid for the affected Services.
Our Services are provided "as is" and without any other warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be error-free or uninterrupted or that all errors will be corrected.
Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our Services, even if we have been advised of the possibility of such damages.
Our total liability in any matter arising out of or related to these Terms or our Services shall be limited to the amount you paid for the Services giving rise to the liability, or CHF 100, whichever is greater. This limitation will apply regardless of the form of action, whether in contract, tort, or otherwise.
Indemnification
You agree to indemnify, defend, and hold harmless Bueler.io, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your infringement of any intellectual property or other rights of Bueler.io or any third party.
Termination
We may terminate or suspend your access to our Services, with or without cause, at any time and without notice. You may also discontinue your use of our Services at any time. Termination or suspension of your access to our Services shall not relieve you of any obligations arising or accruing prior to such termination or suspension or limit any liability that you otherwise may have to Bueler.io.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Switzerland.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions of these Terms, which shall remain in full force and effect.
Entire Agreement
These Terms, together with any order forms, quotes, or invoices, constitute the entire agreement between you and Bueler.io with respect to our Services and supersede all prior or contemporaneous understandings, agreements, or communications, whether written or oral, relating to the subject matter hereof.
